Website Terms and Conditions of Use ("Terms of Service")

These Terms of Use ("Terms") are a legal agreement between you ("you" or "User") and Farmapper, LLC, an Idaho limited liability company ("we," "us," or "Farmapper"), governing your use of the farmapper.com website and hosted application (collectively, the "Service").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Farmapper Is

Farmapper is a web-based software-as-a-service (SaaS) mapping tool for real property. It lets you:

  • Look up and visualize U.S. Bureau of Land Management ("BLM") Public Land Survey System ("PLSS") sections, townships, and ranges;
  • Draw, save, and edit map shapes and property polygons on an interactive map;
  • Store project data associated with your account;
  • Export map geometry in standard GIS formats (such as KML, GeoJSON, and Shapefile); and
  • Access other mapping and land-related features we add over time.

The Service is delivered entirely through your web browser. There is nothing to download or install. No desktop, mobile, or downloadable "application" is offered or licensed under these Terms. References in earlier versions of our terms to downloading an "Application" or to "McFinney.com" no longer apply — the product is now delivered under the Farmapper brand as a hosted web service.

2. Eligibility and Account

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction to use the Service. Certain features require an account. You are responsible for the accuracy of information you provide and for maintaining the confidentiality of any credentials associated with your account (including any credentials issued through a third-party identity provider such as Google).

3. Your Content and Rights

3.1 What you upload or create. Through the Service you may submit, upload, or create written legal descriptions, notes, and project metadata; scanned deed images or PDF documents ("Deed Files"); coordinates, points of beginning, and other geographic inputs; map shapes, polygons, and other geometry you draw or generate; and exported files in KML, GeoJSON, Shapefile, and other formats we support (collectively, "User Content" and, where generated by the Service, "Generated Output").

3.2 You keep ownership. You retain all right, title, and interest in your User Content, including any Deed Files, notes, and project data you upload. Uploading material to Farmapper does not transfer ownership to us. We do not claim copyright or any proprietary interest in your source material.

3.3 Generated Output belongs to you. Map shapes, polygons, coordinate lists, and exported files (including KML, GeoJSON, and Shapefile) generated by the Service from your User Content are yours to use without restriction. You may use Generated Output for any lawful purpose, personal or commercial; modify, redistribute, incorporate into other work, publish, sublicense, or sell Generated Output; and retain, delete, or store it as you see fit. We claim no ownership over Generated Output and do not require attribution, royalties, or any downstream license from you for its use. Attribution to Farmapper is appreciated but not required.

3.4 Third-party data disclaimer. Generated Output that is derived in whole or part from BLM PLSS data or other public datasets remains subject to the underlying data provider's terms (see Section 5 and our Data Policy). We do not, and cannot, grant you rights greater than those provided by the original data source. Nothing in Section 3.3 is intended to override the disclaimers and reservations of those upstream data providers.

3.5 Limited license to us (to run the Service). So we can actually deliver the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, display, and analyze your User Content and Generated Output solely to (a) provide the Service to you, (b) support and troubleshoot your account, (c) improve accuracy and reliability of the Service in aggregated or de-identified form, and (d) comply with applicable law. This license ends when you or we delete the content, subject to reasonable backup and log-retention periods described in our Privacy Policy.

3.6 What you promise about your User Content. You represent and warrant that you have the legal right to submit each Deed File, description, or other item you upload, and that doing so does not infringe any third party's rights or violate any law. You are solely responsible for the legality of what you upload.

3.7 Deletion. You may delete your projects, shapes, and account through the Service. Deletion removes your content from active systems; residual copies may persist in backups for a limited time before being overwritten in the ordinary course, as described in our Privacy Policy.

4. Pricing, Payment, and Free Tier

Some features are available on a free tier; others require a paid plan or one-time charge. Current pricing is displayed on the Service and may be updated from time to time.

  • Payment processing. All payments are processed by Stripe. We do not store full card numbers on our servers.
  • Refunds. Refunds for paid features are handled in good faith on a case-by-case basis. Contact support with details.
  • Taxes. You are responsible for any applicable sales, use, VAT, or similar taxes on your transactions unless we collect them at checkout.

5. Accuracy Disclaimer — Read Carefully

Farmapper is an informational mapping tool. It is not a substitute for a professional land survey, title search, or legal opinion. Any map, polygon, acreage figure, or export produced by the Service is provided "as is" for informational purposes only and must not be used as an official boundary description or as the basis for any legal, engineering, construction, financing, insurance, or transactional decision without independent verification by a licensed professional (such as a licensed land surveyor, title officer, or attorney).

5.1 AI-assisted features. Certain Farmapper features use artificial-intelligence models to parse legal descriptions, read scanned deeds, classify content, or suggest geometry. AI parsing is inherently probabilistic. It can and does make mistakes, including but not limited to:

  • Misreading handwritten, faint, faxed, or low-resolution scans;
  • Misinterpreting ambiguous, unusual, or historically drafted legal descriptions;
  • Applying an incorrect Point of Beginning, bearing convention, magnetic-declination adjustment, or unit of measure;
  • Missing exceptions, easements, road rights-of-way, water boundaries, or reservations described in the source;
  • Producing geometry that is geometrically valid but factually wrong.

You are solely responsible for reviewing every Generated Output against the underlying legal description and official records before relying on it. Do not use Generated Output as-is for filings, closings, permits, disputes, or any other consequential purpose without independent verification.

5.2 BLM / PLSS cadastral data limitations. The Service incorporates PLSS cadastral data published by the U.S. Bureau of Land Management, along with certain state-level datasets such as the Texas Natural Resources Information System survey data. BLM and other data providers publish that data "as is" and disclaim responsibility for errors, omissions, and accuracy. You acknowledge that:

  • PLSS boundaries in the BLM dataset are approximate and may not match the actual monumented boundary on the ground;
  • PLSS coverage is uneven and largely limited to states west of the Mississippi River, plus certain other jurisdictions;
  • Data may change over time, and the Service may not reflect the most current version;
  • Some polygons displayed by the Service are algorithmically derived from PLSS outer bounds and may not correspond to any officially surveyed subdivision;
  • Official PLSS records may only be obtained from the appropriate BLM state office or your local county recorder.

The full BLM data-use disclaimer applicable to the Service is included in our Data Policy and is incorporated into these Terms by reference. Any reliance on PLSS-derived output is at your own risk.

5.3 No warranty of accuracy or fitness. To the maximum extent permitted by law, we disclaim any warranty that any map, polygon, acreage figure, description, or export is accurate, complete, current, error-free, or fit for any particular purpose, including boundary determination, title assurance, easement identification, or acreage calculation.

6. Acceptable Use

You agree not to:

  • Use the Service to violate any law or third-party right;
  • Upload content you do not have the right to upload;
  • Attempt to reverse engineer, decompile, or extract source code from the Service (except to the extent this restriction is prohibited by law);
  • Introduce malware or automated abuse into the Service;
  • Rate-limit-evade, resell API access without written permission, or scrape the Service in ways that materially degrade its performance for others;
  • Use Generated Output to knowingly misrepresent property boundaries in a way likely to harm a third party.

7. Intellectual Property in the Service Itself

The Service — including the Farmapper name and logo, the software that powers the site, the user interface, layout, documentation, and any non-user-generated content we publish — is our property or the property of our licensors, and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Service in accordance with these Terms. Nothing in these Terms transfers any of our intellectual property to you. See Section 3 for the separate rules that apply to your User Content and Generated Output.

8. Availability, Changes, and Termination

The Service is provided on an "as available" basis. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may terminate or suspend your access if you materially breach these Terms or use the Service in a way we reasonably believe creates legal risk. You may stop using the Service and delete your account at any time.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARMAPPER, LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR ANY GENERATED OUTPUT, WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE DURING THAT PERIOD, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Indemnification

You agree to defend, indemnify, and hold Farmapper, LLC and its owners harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from (a) User Content you submit, (b) your use of Generated Output, (c) your breach of these Terms, or (d) your violation of any law or third-party right.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Any dispute arising under these Terms must be brought in the state or federal courts located in Ada County, Idaho, and you consent to personal jurisdiction and venue there. Nothing in this section prevents either party from seeking injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the "Last Updated" date at the top and, where practical, communicated by email or an in-app notice. Continued use of the Service after an update means you accept the revised Terms.

13. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and the Data Policy, are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is held unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
  • Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
  • No agency. Nothing in these Terms creates a partnership, joint venture, or employment relationship.
